This privacy policy (hereinafter referred to as “Privacy Policy”) applies to you the user of the website accessible by the url www.cro123.com, and cro123, a mobile app / application, designed and developed by Inforcom Technologies Private Limited, a ROC registered company in India (hereinafter, referred to as “cro123”).

The App/website offers service to list the Clinical Studies at various Independent CROs and Pharma Company CROs (hereinafter referred to as “CRO”) in need of Volunteers to participate in it (hereinafter referred to as “Service”). Both the User and CRO123 together shall be referred as “Parties”. The Services will be given to people who want the study information on the App/website by registering on the site / app as per the approach designed by cro123 (herein referred to as “User”, also applicable to the casual visitor using the App/website). Certain User data will be transferred to the CROs for their perusal.

CRO123 will require to collect and to retain data of the Users. This Privacy Policy is to inform the User the following: what personal information will be collected, why it is collected and how it will be used, how it will be shared and to whom, the data protection plan.

This Privacy Policy shall apply to the use of the App/website by all Users. All Users shall read and understand the terms and conditions mentioned here before providing any Personal to cro123.

This Privacy Policy is published in compliance of the Indian Information Technology Act and Rules of Reasonable Security Practices and Procedures and Sensitive Personal Data.

When using the site www.cro123.com, cro123 may hold the information about the User’s browsing history including the macId of the device or the IP address of the device used, computer / mobile operating system, browser used and the ISP used. The App/website has options to access information of Users by CROs or other Users. cro123 disclaims any liability for any misuse of such information that was voluntarily put on cro123 by Users / visitors.

CRO123 may in offer other services like but not limited to surveys, quizzes, contest, Service improvement etc. and ask for additional information, or prior information may be used. Further as per the Privacy Policy such information will be processes and used.

How the User information will be used by cro123 -

cro123 will retain User Information to provide Services to the CROs. The information which cro123 collects from the User may be utilized for various business and/or regulatory purposes including for the following purposes: Registration of the User on the App/website, Processing the User’s requests, Completing transactions with Users effectively and billing process, Technical administration and customization of App/website, content presentation to Users, Delivery of personalized information and target advertisements, Improvement of Services, features, Research and development, Information that can identify a person may be used for internal research, statistical analysis and business intelligence purposes. Cro123 may sell or transfer such research, statistical or intelligence data to third parties and affiliates.

The information collected from the Users may also be used for requests, enquiries, complaints or disputes processing, Planning of Contests for Users and Prize management, Informing any changes in CRO123 Services or this Privacy Policy, to prevent frauds; and

Where and why the User information will be shared and sent -

As per the Privacy Policy, CRO123 may need to disclose/ transfer User’s Personal Information to the following third parties for the purposes mentioned:
Other service providers appointed by cro123 for the purpose of carrying out services on cro123;
To CROs to contact the Users to invite them for the studies;
To CRO123 affiliates in India or in other countries;
To government institutions or authorities if required under the laws of judicial or other legal body. This is to protect and defend the rights or property of cro123, to fight frauds on CRO123, to enforce cro123's Privacy Policy, to protect CRO123’s own rights when cro123 is advised as necessary.

User information may be disclosed to third party ad servers, ad agencies, technology vendors and research firms to serve advertisements to the Users. cro123 may also share the User information as is or processed to prospective investors, strategic partners, sponsors and others in order to help growth of cro123's business.

CRO123 may also disclose or transfer the User Information to a party as part of reorganization of its own organization or sale of cro123 business.

User is required to stop using CRO123 in order to stop the personal information being transferred to the CROs for project invitations and inquiries. This will not be retroactive. The above also applied to a casual visitor who used the Service prior to reading the Privacy Policy.

User information holding plan on CRO123 -

As per the Privacy Policy, All the information collected is maintained by cro123 in electronic form on its equipment. User Information may also be converted to physical form from time to time.

The agenda to collect User data is to help the CROs and other organizations as well as industries to plan and manage their projects. CRO123 may submit such information to the CROs who request access to such information at a charge as decided by CRO2123. The App/website is also designed to use the data of CROs for assisting the Users to access information relating to the studies at the CROs. cro123, therefore, retain and submit all such records to the relevant Users.

Online advertisements -

The links to third-party advertisements linked by various sources referred as “Third Party Links” may be provided on the App/website which are operated by third parties and are not associated in any way with cro123.

CRO123 requests the User to review the App/website’s privacy policy in case User wishes to access such Third Party Links. CRO123 is not responsible for the policies or practices of Third Party Links.

Security aspect of User information -

CRO123 uses sufficient and reasonable steps to safeguard the information. While CRO123 makes best efforts to offer security practices in alignment of the industry standards, CRO123 cannot ensure or warrant complete security of all information that is being transmitted to CRO123 by you and vice versa because of the inherent vulnerabilities of the internet and the machines / equipments used in the process.

CRO123 is not responsible for any intercepted information during transmission over the internet. CRO123 is not responsible for any use of the intercepted information. Further the misuse of information obtained due to unfavorable acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

Service access to User -

CRO123 reserves the right to discontinue the services for a User at any given time without a notice. This may be due to but not limited to untrue or misleading information provided by the User or the user is found or suspected using this service as his/her/ its own business in any aspect or is found loading malware or damaging / obscene / unacceptable material (as per discretion of CRO123) to the site.

The value added services which is chargeable will be discontinued as the usage term expires for the payment made. However the free services shall be continued. There will be no refund of any kind for any / all payments done for this Service. The price for the value added service may change at anytime without prior intimation to the users of cro123.com

Additional notes to User -

The User shall use the Services at his/her/ its own risk. It is advisable to check the authenticity of the information obtained from the site / app. For any untrue information posted accidentally or purposely by any data posting entity, CRO123 shall not be responsible for any damage and will be freed from any / all claims resulting from the usage of the Service.

The User is responsible for maintaining the confidentiality of the User's account access information and password. The User shall be responsible for all uses of the User's account and password, whether or not authorized by the User.

cro123 will communicate with the Users through site and the App. The Users can ask / complain to cro123, by sending an email to askcro123@gmail.com cro123 shall handle grievances of all Users received via email askcro123@gmail.com

Privacy Policy changes-

CRO123 may update this Privacy Policy at any time, with or without advance notice. These changes shall be communicated to the User on the App/website and the User shall provides his/ her/ its consent to the changed practices.

By entering this App/website and clicking the “I accept” button, the User consents to the terms of this Privacy Policy. By submitting his/her/ its data/information to the CRO123, the visitor will be treated as having given his/her/ its permission for processing the same in a manner provided in this Privacy Policy.

Disclaimer

CRO123 is a mobile app / website designed and developed by Inforcom Technologies Private Limited, a ROC registered company in India (hereinafter, referred to as “cro123”). The user of the services offered by CRO123 will be referred as “User”.

CRO123 guarantees reasonable l uptime of systems for use of volunteers. The Service output information provided can vary in terms of its position and format or certain information can be discontinued under certain unavoidable circumstances such as changing government policies, legal or criminal or social issues, National or International Quality / Compliance, Auditor’s comments or pertaining to other social responsibilities or the safety of the Service Providers’ personnel etc. CRO123 shall carry out the changes as and when required without prior notifications. There is no hard copy or electronic copy of the User Manual for this service..

CRO123 shall not be responsible for the quality and matching results of any search by any options give due to but not limited to the performance limitation of the networks, hosting servers as well as the unavailability of The Service due to, including but not limited to the Internet or Hosting Server related issues.

The Service displays the output information sent by the participating CROs, disseminating on CRO123 on ‘as is’ basis. Any erroneous, incomplete, late or incorrect information sent by a participating CRO, shall not be checked, modified or verified. The results shall be based on the inputs provided via document, inputs by CRO personnel or data collected from the internet. CRO123 does not guarantee the authenticity of the data on the CRO123 service. CRO123 shall not be responsible for any duplicate or fraudulent or incorrect data on the site / app.

The Service does not guarantee the enrollment in a study. The CRO shall be taking the final call for the enrollment of a volunteers in a study. Volunteers understands the possible risks associated to the study participation at CROs. The volunteers shall use CRO123 service at their own risk.

Further, CRO123 shall not be liable for any legal actions or financial damages, of any type or nature occirung due to the use of CRO123 as well as by any false information or absence of such information on the website / app.

Payment and Invoicing

a) The User shall pay CRO123 to access the value added services. The same shall be valid for a limited period of time. The validity shall be displayed on the site/app for each User.
b) A single line payment detail shall be availed after each payment. Detailed invoice can be viewed on the website CRO123.com
c) The items offered under value added section can vary as per the decision of CRO123 without any prior intimation.
d) The correct mobile no. should be entered for value added service activation. Payment once made cannot be transferred to other mobile no.
e) The value added service will be deactivated at midnight of the end of the 30th days from the payment date.

Termination

CRO123 has authority to discontinue the access rights given to the User after without prior intimation due to but not limited to misuse or inappropriate use of the website / app, indecent content upload to CRO123.
CRO123 has full right to discontinue the service itself due but not limited to any external reason or internal business decision. CRO123 can be merged with other services or be renamed at their own decision without prior intimation to the Users.

Governing Law and Construction

This Agreement will be governed by and construed in accordance with the laws prevailing in India. The Parties attorn to the jurisdiction of competent and appropriate courts at, Ahmedabad, State of Gujarat, India. All disputes, claims arising out of this agreement shall be attempted to be resolved amicably by the both the parties.

Other

No term in this agreement binds CRO123 and the User to enter into any other agreements for the subject matter of this document.

CRO123 can assign or transfer any rights or obligations under this Agreement without the prior intimation to any User.

CRO123 shall NOT be liable and responsible under any circumstances to –
a. Provide any expenses to cure a matter that gives rise to the claim for which usage of CRO123 is responsible.
b. Return the fees paid by the User along with necessary and adequate compensation for any loss of any type and form.
c. Pay any cancellation fees for the value added services of CRO123.
d. Indemnify the User against any irreparable damages incurred due to the claims from the use CRO123 – for free or paid service.
e. Indemnify the User for all legal and other expenses incurred on account of seeking legal remedies and help to protect the User from various claims.

CRO123 shall not be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is either wholly or partly due to Force Majeure conditions in whole or in particular such as earthquake, storms, flood, fire, other acts of nature, epidemics, pandemics, war, riots, hostility, public disturbance, acts of public enemies, prohibition or act by a government or public agency, such as ban on imports, strikes, or other labour disputes or work stoppage. CRO123 affected by such Force Majeure condition shall announce the same on its website / app provided the access of the same is possible on the internet.

A User, in case withdraws itself from using CRO123 website / app, under any reason or finds the Service incompetent or insufficient or has any objection or concerns for any feature, shall not compel CRO123 to discontinue the Service. Further the User will not have any objection in Service Provider offering this Service to anyone anywhere.

CRO123 has full rights to display or hide an advertisement banner on any page of the CRO123 website / app at their own discretion. The terms and conditions of the advertised company is an internal matter of CRO123 and will not be displayed to the Users.

Implementation of the external suggestions for quality or maintenance methods, techniques, frequency and processes will be at the discretion of CRO123. No Audits requests by a User will be considered by CRO123.
